maryland trust litigation attorneys
the word "trust" is a very generic one and can mean many different things. basically, if one person is holding property for the benefit of another, there is a trust. the person who controls the trust assets is the "trustee".
the word "litigation" means a contest in a court of justice for the purpose of enforcing a right. if you were to file a lawsuit against someone, you would be engaging in litigation.
when there are disputes about trusts and the dispute ends up in a court, we then have "trust litigation".
of the many kinds of trusts, there are two that are common. one is a trust that is part of a person's last will and testament. this is known as a "testamentary trust". the second is a revocable trust sometimes referred to as a living trust. these kinds of trusts are typically established by people while they are alive, primarily to avoid the probate process when they die.
many different kinds of disputes can arise related to trusts, both when people are alive and after they have died. some examples are:
- beneficiaries of a trust might believe that a trustee has misappropriated or improperly handled assets.
- they might have asked for an accounting and been ignored or refused.
- the trustee might be making improper investments.
- the trustee might have made improper distributions to himself or someone else.
- the trustee might have been directed to make distributions but failed to do so and will not respond.
